This Refund & Cancellation Policy (“Policy”) is a legally binding agreement between you (“Customer,” “you,” “your”) and DesertSafari.shop, a project of KLIKX LTD (“Company,” “we,” “us,” “our”). By booking a tour, activity, or service (“Service”) through our website, phone, or any other channel, you explicitly acknowledge, understand, and unconditionally agree to be bound by the strict terms and conditions outlined in this Policy. We strongly advise you to read this document in its entirety before making any purchase.

1. General No-Refund Principle

All sales for our Services are considered final. We operate on a strict no-refund basis for completed services and for cancellations made by the customer within the stipulated timeframes below. The Company, at its sole and absolute discretion, may offer a credit voucher or a partial refund only under the specific circumstances defined herein, and such an offer shall not set a precedent for future cases.

3. No-Show Policy

A “No-Show” is defined as a customer who fails to be present at the designated pickup location at the scheduled pickup time. The Company’s driver/representative will wait for a maximum of 5 minutes. In case of a No-Show, the booking will be deemed fully utilized, and 100% of the total booking fee will be forfeited without any entitlement to a refund, credit, or rescheduling.

4. Changes, Delays, and Itinerary Alterations by the Company

The Company reserves the absolute right to alter, modify, or cancel any tour due to factors beyond its reasonable control, including but not limited to: adverse weather conditions, sandstorms, government directives, security concerns, vehicle breakdowns, or any other event constituting a force majeure.

The Company also reserves the right to change the sequence of activities, the camp location, or the specific route of the desert drive at any time without prior notice. Such alterations are not grounds for a refund.

5. Dissatisfaction with Services

We strive to provide excellent service. However, complaints regarding the subjective quality of the experience (e.g., “the food was not to my liking,” “the dune bashing was too short,” “I didn’t enjoy the entertainment”) do not qualify for any refund or credit. Any claim of service failure must be reported immediately to our on-ground representative and confirmed in writing via email to us within 2 hours of the tour’s completion. We will investigate such claims at our discretion, but acknowledgment of an issue may, at best, result in a partial credit voucher, not a cash refund.

6. Third-Party Liabilities & Indemnification

The Company acts as an intermediary between you and the licensed tour operators. We are not liable for any acts, omissions, errors, representations, warranties, breaches, or negligence of any third-party service provider. The Customer agrees to participate in all activities at their own risk. The Company shall not be held liable for any personal injury, property damage, loss of belongings, accidents, or incidental expenses incurred during the tour.

By booking our Services, you agree to indemnify, defend, and hold harmless KLIKX LTD, its affiliates, and its partners from any and all claims, demands, damages, losses, liabilities, and expenses (including legal fees) arising out of or in any way connected with your participation in the tour.

7. Governing Law and Jurisdiction

This Policy and any disputes arising from it shall be governed by and construed in accordance with the laws of the United Arab Emirates, and specifically the Emirate of Dubai, without regard to its conflict of law principles. The Customer irrevocably agrees that the courts of Dubai shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Policy.

8. Policy Acknowledgment

By proceeding with a booking, you explicitly confirm that you have read, understood, and voluntarily agree to every clause in this Refund & Cancellation Policy in its entirety. You further acknowledge that no verbal assurances from any sales or support agent can override or amend the written terms of this Policy.
